Terms of Service
Parties
This agreement is deemed to be established and signed with the mutual agreement of the parties between ENGLISH GURU LLC (hereinafter referred to as "English Guru") residing in the United States and the person, institution or organization (hereinafter referred to as "Member" and/or "Buyer") who fills out the Registration Form, as of the date the Registration Form is filled out and approved over the internet.
Approval of the Agreement
By using English Guru, you agree to the Terms of Service and Privacy Policy. If you do not accept these terms, you may not use the English Guru platform.
Amendments to the Terms and Service
English Guru has the right to amend this agreement at any time. Your continued use of the site following notification of a change in the agreement means you accept the changed terms of use and service.
Credit Card Payment
If your credit card expires, is cancelled, lost or invalidated after your first registration, you face the danger of your subscription being terminated. We will contact you and give you the opportunity to update your credit card. If your credit card cannot be successfully updated, your subscription will be terminated. In payments with a Credit Card, a commission fee may be collected by the bank institution to which the member's card is linked, and the member accepts that this commission amount will also be collected from the credit card during the payment process.
I accept that in installment sales, my subscription or package will be suspended if the due installment is not paid within 1 week.
English Guru Membership System
The education and all rights of members who share their user code (email address) and/or password with other people will be canceled. All obligations arising as a result of sharing the user code (email address) and password with others are the sole responsibility of the member, and English Guru accepts no liability.
Description of Services
English Guru members will be deemed to have accepted to take distance education on websites belonging to English Guru over the internet. The fee paid by the member for education includes the cost of education services and communication.
Unless otherwise stated, all materials such as documents, audio files, presentation files, video files, e-books, etc. presented within the educational system are distributed free of charge and are integrated into the system for educational purposes. All rights to the documents belong to the producers, authors, and license holders. While English Guru does not claim any additional rights over these documents and materials, it is committed to completely removing the relevant educational materials from the system upon the request of the rights holder.
Any negative/unofficial/illegal situation that may occur as a result of applications based on the education provided by English Guru is entirely the responsibility of the member, and English Guru has no responsibility in this regard. The education provided within English Guru is for the purpose of advancing/increasing the personal or professional development of the members; it is assumed that the member has knowledge in the relevant educational field, and all positive/negative responsibilities are left to the member.
Member's Obligations
Services provided by English Guru have an age restriction. Users under 18 years, who are minors, require the permission of a parent/guardian. As no services will be provided to minors without parent/guardian permission, the age declared by the member will be considered, and English Guru cannot be held responsible for any incorrect information provided by the member.
It is accepted that any recordings or all information obtained using English Guru services are used with the member's own consent. The member is entirely responsible for any malfunctions, data loss, and other losses that may occur on the member's personal computer. English Guru will not be asked for any material or moral compensation due to damages that may occur.
The member makes purchases on the system by credit card with their own consent and as agreed in the Registration Form. The responsibility for purchases made with stolen credit cards and unauthorized use of credit cards lies entirely with the members using the information. The member is responsible for the legal liabilities and compensations arising from such transactions; English Guru has no legal liability. Upon request, the information of members using this data will be provided to official institutions.
The USER/STUDENT MEMBER agrees not to provide contact information that would enable instructors to communicate with them on any platform other than English Guru. If this situation is detected, your subscription will be immediately terminated, and no refund will be issued for the unused portion of your training package.
Obligations of English Guru
English Guru commits to always having instructors available in the system. Even if an instructor you are taking lessons from leaves the system after a while, English Guru commits to providing the student with an alternative instructor. If English Guru’s commercial life ends for any reason, the remaining package service fees will be refunded to members.
Personal information requested from users will not be shared with third parties under any circumstances unless requested by judicial authorities.
Authorizations Granted to English Guru
Assuming the information provided by the members is correct, English Guru will ensure the continuity of the prepared training. English Guru accepts no liability for errors in the data provided to the system or internet connection problems.
Promotional packages or discount coupons/gift certificates offered to members are limited by quotas and stocks. English Guru may end the campaign before its due date or extend its duration.
Once the member’s education is activated, English Guru can permanently send all kinds of e-mail messages, SMS messages, advertisements, and promotional activities; it can support the realization of these types of activities using the member information within English Guru, or it can carry out these activities directly.
English Guru does not share the personal information of its instructors with the service recipient. If English Guru instructors or employees are subjected to any pressure, bad language, manners, morals, or inappropriate behavior by the service recipient, English Guru has the right to unilaterally terminate this agreement.
Product Returns and Use of the Right of Withdrawal
There is a right of withdrawal within 14 days from the date of the contract. If the right of withdrawal is not used within 14 days from the contract date, the USER/STUDENT loses the right to withdraw. Subscription cancellation is calculated based on the package start date, not the lesson duration. In case of cancellation, calculations are made over the non-discounted price, and fee refunds are made for the remaining days.
The return will be made to the bank account number or credit card number of the USER/STUDENT MEMBER. English Guru cannot be held responsible for delays experienced through the bank or other payment channels.
Since all entries into the system are recorded in the member's account along with a dedicated timestamp and IP number, these records in our system will serve as evidence against all legal objections.
English Guru reserves its rights regarding rights losses and other material/moral losses suffered due to subscription cancellation and the use of the right of withdrawal. English Guru cannot be held responsible for the losses of rights suffered by members in accordance with legal regulations.
Dispute Resolution
In the event of any dispute regarding the content of this customer service policy or the services/training/products received; the legislation provisions to which the English Guru organization is subject shall apply, and the COMMERCIAL COURTS to which English Guru is affiliated are authorized.
English Guru reserves the right to determine/change the competent resolution authority, applicable legislation, and provisions through the user agreement.
